Terms of Service

These Terms of Service govern access to and use of ClubAxis. They apply to visitors, registered users, and clubs that subscribe to or use the platform. By using ClubAxis you agree to these terms. If you are signing up on behalf of a club, sections 11–14 apply to your organisation as a customer.
1. Agreement to these terms
ClubAxis provides website and management services for football and sports clubs. By accessing or using our websites, applications, or APIs ("the service"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.
2. Who may use the service
- Visitors may browse public areas of the ClubAxis company site or club sites subject to these terms.
- Registered users(members, officials, administrators) must provide accurate information and comply with their club's rules and applicable law.
- Club customersmust be a constituted club, league, or similar organisation, or an individual with authority to bind that organisation. The person who creates a club account confirms they have authority to do so on the club's behalf.
- You must be at least 18 years old to create a club administrator account. Clubs are responsible for how they register minors as members on the platform.
3. Acceptable use
You must use ClubAxis lawfully and responsibly. You must not:
- Violate applicable laws, regulations, or third-party rights.
- Upload unlawful, defamatory, harassing, or infringing content.
- Impersonate any person or misrepresent your affiliation.
- Attempt unauthorised access to the service, other accounts, or other clubs' data.
- Introduce malware, scrape the service excessively, or disrupt its operation.
- Send spam or unsolicited bulk messages through the service.
- Use the service in a way that harms children or bypasses safeguarding controls.
We may suspend or terminate access if we reasonably believe you have breached these terms or pose a risk to the service or others.
4. Accounts and security
You are responsible for keeping login credentials confidential and for all activity under your account. Notify us promptly at privacy@clubaxis.co.uk if you suspect unauthorised access. We are not liable for losses caused by your failure to protect credentials, except where required by law.
5. Your content and licence to ClubAxis
You retain ownership of content you upload or create. You grant ClubAxis a non-exclusive, worldwide licence to host, store, reproduce, display, and distribute that content solely as needed to operate the service (including showing your club website, delivering messages, and posting to connected social media when you choose). You confirm you have the rights to upload content and that it does not infringe others' rights. Clubs are responsible for obtaining permissions for photos and personal data they publish about members.
6. Intellectual property in the platform
ClubAxis, its software, branding, and documentation remain our intellectual property or that of our licensors. Except for the limited right to use the service during an active subscription or permitted trial, no rights are granted to copy, modify, or reverse engineer the platform.
7. Social media integrations
Optional connections to Facebook, X, or other platforms are subject to those providers' terms. We publish only when an authorised user selects post or share. Disconnect integrations at any time in club settings. We are not responsible for third-party platform actions or policies.
8. Availability and changes
We aim to keep the service available but do not guarantee uninterrupted or error-free operation. We may modify features, perform maintenance, or discontinue parts of the service with reasonable notice where practicable. Planned maintenance and material changes affecting club customers will be communicated where possible.
9. Disclaimer of warranties
The service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. ClubAxis is a software tool; we do not provide legal, safeguarding, medical, or professional advice. Clubs remain responsible for their own compliance and decisions.
10. Limitation of liability
To the maximum extent permitted by law, ClubAxis and its officers, employees, and contractors shall not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from use of the service. Our total aggregate liability for claims relating to the service in any twelve-month period shall not exceed the greater of (a) £100 or (b) the fees paid by your club to ClubAxis in that period (or zero if no fees were paid). Nothing in these terms excludes liability that cannot be excluded under applicable law (including death or personal injury caused by negligence, or fraud).
11. Club customers — authority and responsibilities
If you register or manage a club on ClubAxis, you agree on behalf of that club that:
- You have authority to enter into these terms and bind the club to our Privacy Policy, data processing terms, and related policies.
- The club is the data controller for member and player data it enters, and will provide its own privacy information to members where required.
- The club has a valid lawful basisunder UK GDPR (and will obtain parental or guardian consent where required) for processing personal data, including children's data.
- The club maintains appropriate safeguarding policies and will use welfare features in line with those policies.
- Officials you invite will comply with these terms and the club's instructions.
12. Club customers — data ownership and processing
Club data remains the club's.ClubAxis processes it only to provide the service on the club's instructions. On request or termination, clubs may export data using available tools or by contacting support. We will delete or return club personal data in line with our Privacy Policy (typically within 90 days after closure, subject to backup retention). A formal Data Processing Agreement is available on request from legal@clubaxis.co.uk. Sub-processors are listed at /sub-processors.
13. Club customers — fees and payment
Where a club subscribes to a paid plan, fees, billing intervals, and payment methods are shown at order or in the club account. Fees are due as stated on the invoice or checkout page and may include VAT where applicable. Failure to pay may result in suspension. We may change prices on renewal with at least 30 days' notice to the club billing contact. Refunds are handled according to the offer accepted at signup or as required by consumer law where it applies.
14. Suspension, termination, and effect
Either party may end use of the service as described in your plan or by written notice where no fixed term applies. We may suspend or terminate immediately for material breach, non-payment, or risk to security or other users.
On termination, access to the club account ends. The club should export any data it needs before closure. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations of liability, indemnity, and governing law) continue in effect.
15. Indemnity
Where you use the service on behalf of a club, you agree to indemnify and hold ClubAxis harmless against claims, losses, and reasonable costs arising from the club's content, misuse of the service, breach of these terms, or breach of data protection or safeguarding obligations — except to the extent caused by our negligence or wilful misconduct.
16. Governing law and disputes
These terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction, except that consumers resident in Scotland or Northern Ireland may have mandatory rights to bring proceedings in their home jurisdiction. We encourage you to contact us first to resolve disputes informally.
17. Changes to these terms
We may update these terms from time to time. We will post the revised version on this page and update the "Last updated" date. Material changes affecting club customers may be notified by email or in the platform. Continued use after the effective date constitutes acceptance where permitted by law.
